{"id":6066,"date":"2018-11-07T12:49:54","date_gmt":"2018-11-07T17:49:54","guid":{"rendered":"https:\/\/ops.group\/blog\/?p=6066"},"modified":"2018-11-07T18:18:42","modified_gmt":"2018-11-07T23:18:42","slug":"no-change-to-iran-airspace-warning-despite-new-us-sanctions","status":"publish","type":"post","link":"https:\/\/ops.group\/blog\/no-change-to-iran-airspace-warning-despite-new-us-sanctions\/","title":{"rendered":"No change to Iran airspace warning despite new US sanctions"},"content":{"rendered":"<p class=\"p1\">The US reimposed sanctions against Iran on Nov 5.\u00a0Despite this, so far there has been no change to the <a href=\"https:\/\/ops.group\/blog\/us-issues-new-guidance-on-iran-overflight-risk\/\" target=\"_blank\" rel=\"noopener\">FAA guidance to US operators issued on 9th September 2018<\/a>: <b>flights to Iran are not prohibited, but operators should \u201cexercise caution\u201d when flying in Iranian airspace.<\/b><\/p>\n<p class=\"p1\">However, with the reimposed sanctions comes a new problem if you\u2019re a US operator: you\u2019re <b>allowed<\/b> to overfly Iran, but you\u2019re <b>not allowed<\/b> to pay for all the things needed to make that happen &#8211; things like overflight permits, and nav fees.<\/p>\n<p class=\"p1\">The rule is simple: no US person or business can pay for services in countries with sanctions against them (like Iran), unless that person or business has a licence to do so, issued by the <a href=\"https:\/\/www.treasury.gov\/about\/organizational-structure\/offices\/Pages\/Office-of-Foreign-Assets-Control.aspx\" target=\"_blank\" rel=\"noopener\">Office of Foreign Assets Control\u00a0(OFAC)<\/a>.<\/p>\n<p class=\"p1\">And you\u2019re not allowed to get an agent to do it for you either; it&#8217;s illegal to skirt the OFAC laws by using a 3rd party company (unless, of course, they&#8217;ve been approved by OFAC).<\/p>\n<p class=\"p1\">So the big question we have now is this: <b>if you\u2019re planning to overfly Iran, have you figured out the legalities of paying for services?<\/b> How are you making that work? Know someone who\u2019s got an OFAC licence for Iran? <a href=\"mailto:news@fsbureau.org\"><b>Let us know!<\/b><\/a><\/p>\n<p>And one other thing to watch out for &#8211; operators with US based insurers should <a href=\"http:\/\/www.hfw.com\/Iran-sanctions-Aerospace-focus-May-2018\" target=\"_blank\" rel=\"noopener\">double-check their policies<\/a>, as you may now no longer be covered for flights to Iran, due to the new sanctions.
