{"id":28537,"date":"2025-09-16T05:38:50","date_gmt":"2025-09-16T09:38:50","guid":{"rendered":"https:\/\/ops.group\/blog\/?p=28537"},"modified":"2025-09-17T09:40:52","modified_gmt":"2025-09-17T13:40:52","slug":"dishing-the-dirt-on-aircraft-trash","status":"publish","type":"post","link":"https:\/\/ops.group\/blog\/dishing-the-dirt-on-aircraft-trash\/","title":{"rendered":"Dishing the Dirt on Aircraft Trash"},"content":{"rendered":"<p data-start=\"245\" data-end=\"258\">We\u2019ve had a few reports from OPSGROUP members lately about issues with how international aircraft trash is handled when arriving in the US.<\/p>\n<p data-start=\"770\" data-end=\"1048\">In one case at <strong data-start=\"785\" data-end=\"799\">KMIA\/Miami<\/strong>, a handler said that <strong data-start=\"821\" data-end=\"865\">CBP asked them to track the tail numbers<\/strong> of any aircraft that disposed of trash after leaving the customs ramp. If this happens, CBP may issue fines\u2014and if handlers don\u2019t report it, <em data-start=\"1007\" data-end=\"1013\">they<\/em> could be held responsible instead.<\/p>\n<p data-start=\"1050\" data-end=\"1206\">While there\u2019s no sign of any new rules, it\u2019s a good reminder of how strict the existing requirements are and how expensive it can get if you don\u2019t comply.<\/p>\n<p data-start=\"1208\" data-end=\"1283\">So, what exactly counts as regulated garbage, and how should it be handled?<\/p>\n<h4 data-start=\"1290\" data-end=\"1327\">What Counts as \u201cRegulated Garbage\u201d<\/h4>\n<p data-start=\"1328\" data-end=\"1522\">Certain waste can carry animal diseases or pests into the US. The <strong data-start=\"1394\" data-end=\"1402\">USDA<\/strong> and <strong data-start=\"1407\" data-end=\"1416\">APHIS<\/strong> require this type of trash to be handled under strict rules (CFR Title 7 <a href=\"https:\/\/www.ecfr.gov\/current\/title-7\/subtitle-B\/chapter-III\/part-330?toc=1\" target=\"_blank\" rel=\"noopener\">330.400 &#8211; 402<\/a>, and <a href=\"https:\/\/www.ecfr.gov\/current\/title-9\/chapter-I\/subchapter-D\/part-94\/section-94.5\" target=\"_blank\" rel=\"noopener\">CFR Title 9 94.5.<\/a>).<\/p>\n<p data-start=\"1524\" data-end=\"1551\"><strong>Regulated garbage includes:<\/strong><\/p>\n<ul>\n<li data-start=\"1554\" data-end=\"1630\">Any food waste, fruits, vegetables, meats, or other plant\/animal products.<\/li>\n<li data-start=\"1554\" data-end=\"1630\">Anything that has touched those items\u2014like packaging, napkins, or utensils.<\/li>\n<\/ul>\n<p data-start=\"1712\" data-end=\"1737\"><strong data-start=\"1712\" data-end=\"1735\">Time limits matter:<\/strong><\/p>\n<ul>\n<li data-start=\"1740\" data-end=\"1793\">From <em data-start=\"1745\" data-end=\"1766\">any foreign country<\/em> in the past <strong data-start=\"1779\" data-end=\"1790\">2 years<\/strong>.<\/li>\n<li data-start=\"1740\" data-end=\"1793\">From <em data-start=\"1801\" data-end=\"1827\">Hawaii or US territories<\/em> in the past <strong data-start=\"1867\" data-end=\"1880\">12 months<\/strong>.<\/li>\n<\/ul>\n<p data-start=\"1885\" data-end=\"2004\">You&#8217;ll need to pass this trash to a USDA-approved service so they can dispose of it.<\/p>\n<h4 data-start=\"2011\" data-end=\"2034\">What Isn\u2019t Regulated<\/h4>\n<ul>\n<li data-start=\"2037\" data-end=\"2074\">Trash from <strong data-start=\"2048\" data-end=\"2063\">Canada-only<\/strong> flights.<\/li>\n<li data-start=\"2037\" data-end=\"2074\"><strong>Clean items<\/strong> like magazines or unused paper towels.<\/li>\n<li data-start=\"2037\" data-end=\"2074\"><strong data-start=\"2132\" data-end=\"2167\">Sealed, unopened US-origin food<\/strong> that hasn\u2019t been contaminated.<\/li>\n<li data-start=\"2037\" data-end=\"2074\">Empty cans or bottles for recycling <strong data-start=\"2239\" data-end=\"2283\">only if they\u2019ve never touched food waste<\/strong>.<\/li>\n<\/ul>\n<p data-start=\"2286\" data-end=\"2401\"><strong data-start=\"2289\" data-end=\"2303\">Important:<\/strong> If clean trash gets mixed with food waste, it becomes regulated. So bag international food waste separately and don\u2019t let it mix with clean trash!<\/p>\n<h4 data-start=\"2408\" data-end=\"2427\">Common Questions<\/h4>\n<p data-start=\"2429\" data-end=\"2568\"><strong data-start=\"2429\" data-end=\"2496\">Q: I\u2019m arriving from Hawaii or a US territory. Does this apply?<\/strong><br data-start=\"2496\" data-end=\"2499\" \/>Yes. USDA\/APHIS rules apply to trash arriving from outside the Continental US &#8211; be careful if arriving from Hawaii or other US territories abroad (Guam, Virgin Islands etc). You may have taken off from American soil, but the rules still apply.<\/p>\n<p data-start=\"2570\" data-end=\"2663\"><strong data-start=\"2570\" data-end=\"2595\">Q: What about Alaska?<\/strong><br data-start=\"2595\" data-end=\"2598\" \/>Alaska is considered part of the continental US for this purpose, and so trash from Alaska flights isn&#8217;t regulated.<\/p>\n<p data-start=\"2665\" data-end=\"2860\"><strong data-start=\"2665\" data-end=\"2749\">Q: My catering came from a pre-clearance airport like EINN\/Shannon. Am I exempt?<\/strong><br data-start=\"2749\" data-end=\"2752\" \/>No. Pre-clearance doesn&#8217;t simply let you bypass the disposal rules. Some exceptions do exist but these require certificates\/inspector actions and strict conditions. In practice, pre-clearance alone will not free you from regulated garbage rules. Apparently diseases and pests care not for our paperwork!<\/p>\n<h4 data-start=\"2867\" data-end=\"2900\">Enforcement: Why Miami Came Up<\/h4>\n<p data-start=\"2901\" data-end=\"2980\">While USDA and APHIS make the rules, <strong data-start=\"2938\" data-end=\"2959\">CBP enforces them<\/strong> at ports of entry.<\/p>\n<p data-start=\"2982\" data-end=\"3105\">Enforcement can vary by location, and some airports take a \u201ctreat all trash as regulated\u201d approach to keep things simple.<\/p>\n<p data-start=\"3107\" data-end=\"3167\">If you want to keep unregulated trash separate, you\u2019ll need:<\/p>\n<ul>\n<li data-start=\"3170\" data-end=\"3202\">Clear, documented segregation.<\/li>\n<li data-start=\"3170\" data-end=\"3202\">Advance notification to the customs inspector.<\/li>\n<li data-start=\"3170\" data-end=\"3202\">Records of who you coordinated with (including badge numbers).<\/li>\n<\/ul>\n<p data-start=\"3322\" data-end=\"3381\">Otherwise, CBP can assume non-compliance and issue fines.<\/p>\n<p data-start=\"3383\" data-end=\"3481\"><strong data-start=\"3383\" data-end=\"3399\">Safest bet:<\/strong> Treat all international trash as regulated and dispose of it at the customs ramp.<\/p>\n<h4>More Questions?<\/h4>\n<p>Get in touch with us on <a href=\"mailto:blog@ops.group\">blog@ops.group<\/a>.
